ATF stops enforcing NFA registration for suppressors, SBRs, SBSs and AOWs: what changed and what didn’t

If you’ve been waiting on a Form 4, this one’s for you. Effective October 9, 2026, the ATF no longer enforces the NFA’s prior-approval and registration requirements for people making or transferring suppressors, short-barreled rifles, short-barreled shotguns and AOWs. firearmsnews

How we got here: The One Big Beautiful Bill Act dropped the NFA making and transfer tax on these items to $0 starting January 1, 2026. Then on August 5, a federal judge in the Northern District of Texas ruled in Silencer Shop Foundation v. ATF that the NFA’s registration and transfer rules were no longer a valid use of Congress’s taxing power for $0-tax items. The government didn’t seek to extend the stay, so the injunction is now in effect. concealedcarrysilencerco

What did NOT change:

  • These items are still firearms under the Gun Control Act, so retail background checks, dealer recordkeeping, prohibited-person rules and interstate transfer limits all still apply. nraila
  • Machine guns and destructive devices still carry the $200 tax, and all NFA requirements still apply to them. firearmsnews
  • Check your state law. About 15 states have laws that reference or require federal NFA registration for suppressors, SBRs or related items. Federal non-enforcement doesn’t automatically fix those. candgholsters

The big question: this is an enforcement policy, not a repeal. Some folks argue a future administration could reverse it and demand registration again.

Is anyone buying or building now, or waiting to see if it holds?
