The Supreme Court will decide whether bans on AR-15-style rifles violate the Second Amendment. The cases are set for argument in the session running Nov. 30 to Dec. 9, 2026.
Viramontes is appealing a Seventh Circuit ruling that upheld Cook County’s ban, which criminalizes the sale, transfer or possession of any “assault weapon,” including AR-15s. The Seventh Circuit held that AR-15-style rifles aren’t “Arms” under the Second Amendment, relying on its 2023 Bevis v. City of Naperville decision. Viramontes argues the court misapplied Bruen and ignored Heller.
This is the biggest Second Amendment case since Bruen. The ruling will decide whether the most commonly owned rifle in the country is protected, and it will affect every state with a similar ban.
How do you think the Court rules?
